Road to airport: case goes to SC

A Bangalore-based private investment firm has approached the Supreme Court challenging the Karnataka High Court order which permitted the state to take possession of its more than three acres land for the construction of the approach road to the international airport.

The airport is to be opened in March 2008 by Prime Minister Manmohan Singh.  After the preliminary hearing, a bench posted the matter for detailed arguments on Wednesday.

In the petition, Girias Investment Private Limited said it had purchased the land in November 2005, but the KIADB had acquired it without giving it an opportunity of hearing.

It claimed that the KIADB had issued a notification on June 3, 2006, for the acquisition of 3 acres and 20 guntas land in Kannamangala village in Devanahalli taluk. The Karnataka Government said the construction of the trumpet inter-change road by the National Highway Authority of India (NHAI) between the Bangalore International Airport Limited (BIAL) and the city would not be possible without taking possession of the land.
The Karnataka High Court had rejected the petition of the company saying that the land had been acquired for public interest. 

Senior Advocate Arun Jaitley appearing for the petitioner sought the quashing of the High Court order along with the notification of the State Government to acquire the land. The alignment of the interchange was changed,  leading to the acquisition of the land.

Karnataka Government defended the acquisition saying that the lands were vital for the construction of a trumpet interchange at the junction of the national highway.
