Mrs Gayathri of Vijayanagar had a raw deal with a chit fund. The Bangalore IV Additional Distsrict Consumer Disputes Redressal Forum came to her help by finding the manager of Shriram Chits (Karnataka) guilty of deficient service. It has ordered him to pay Rs 11,100 to Gayathri with costs of Rs 3000.
Gayatri, who had been this chit firm’s customer for years, had raised a ticket from Shriram Chits in 2004 for Rs 2,00,000. After 36 months she became a successful bidder in June 2007. But she did not get the claim amount from the chit firm. They made several excuses and gave her a hard time, trying to get her dues. She complained to the IV Forum and its president, Sri G Siddanagoud ruled that by postponing payment to Gayathri the chit fund firm (which did not appear at the Forum when called for the hearing) was guilty of deficient service.
Rickety deal
Syed Hassan purchased an auto rickshaw put out under public auction from the Dr B R Ambedkar Development Corporation Ltd for Rs 76,000 in 2005. The Corporation handed over the physical possession of the vehicle to Hassan and agreed to transfer the documents along with the permit favouring him.
But it did not transfer the permit or the certificate of registration to him and he could not use his auto rickshaw. An endless trauma of agony and disappointment began for Hassan as the Corporation made him run from pillar to post to get his vehicle. Exhausted and desperate, he at last urged the Corporation to return his money but here too he was not successful and finally complained to the IV Forum. It ruled that when the complainant has paid up the entire amount it was the duty of the Corporation to give him his dues. But the Corporation did not come to the IV additional forum for the hearing.
The Forum President has ordered this Corporation to refund Rs 76,000 to Hassan with interest at 12 per cent along with Rs 5508 he paid towards insurance premium. It also awarded him Rs 3000 as costs and Rs 5000 as compensation.
Messy tie
B S Venkataraman had sent rakhies to his sister through DTDC Courier & Cargo for the Rakshabandhan festival. But the rakhis never reached her and after investigating, he learnt from the courier service that the packet was lost. He complained to this Forum which ordered the courier firm to pay up Rs 100 along with Rs 3000 as costs to the complainant.
Stranded
The Karnataka State Consumer Disputes Redressal Commission, Bangalore has ordered the manager of a bus to pay up Rs 30,000 to a woman passenger who was stranded on a road in the night, when the bus took off without her. Mrs Jyothi Nagaraj of Vidyaranyapura had booked a ticket with Durgamba Motors paying Rs 400, for her journey from Bangalore to Udupi. Her journey was pleasant from Bangalore to Chennarayapatna. Around 1.30 am, the bus stopped near a hotel. She told the conductor that she was going into the hotel to use the ladies room. When she rushed back to board the bus, it took off without her leaving her stranded. While running, she had fallen and hurt her ankle.
She later complained to the I Additional District Consumer Disputes Redressal Forum, Seshadripuram, which found Durgamba Motors guilty of deficient service and ordered it to pay up Rs 30,000 to her as compensation.
