Indian national jailed for 'illegally' living in Pak

The additional district and sessions court in Karachi yesterday sentenced Dinesh Kumar, son of Narain Das, after finding him guilty of living in Pakistan without valid and authentic documents.

Judge Jangu Khan pronounced the verdict after recording the testimonies of prosecution witnesses and hearing final arguments by the defence and prosecution lawyers.
The court also ordered Kumar to pay a fined of Rs 5,000 and said he would have to undergo an additional imprisonment of 15 days if he failed to pay.

The judge said that the National Identity Card produced in court by Kumar should be sent to the National Database and Registration Authority for legal action against him.

The benefit of Section 382-B of the Criminal Procedure Code (period of detention to be considered while awarding sentence of imprisonment) was extended to Kumar and the court directed jail authorities to make arrangements for his deportation that he completed his sentence.

The judge observed that the prosecution was successful in proving the charge against Kumar by providing ample evidence.

He said the documents submitted by Kumar in his defence, including the Pakistani National Identity Card, were obtained fraudulently.

Kumar’s counsel told the court that he was adopted as a son by a Pakistani national named Dayal Das and that he had got married in Pakistan and had children.The public prosecutor contended that documents submitted by Kumar were forged and that he had submitted a "fake plea" to avoid a sentence.

The prosecution said Kumar arrived in Karachi from India in 1993 on a visit visa.
He did not return to India after the visa expired.Police took Kumar into custody in August 2006 following a complaint from Military Intelligence and a case was registered against him under the Foreigners Act
