The court had accepted the evidence and declared him dead. Sital Singh Bagi had to fight a 12-year-long legal battle to prove that he was alive and not dead.  High Court advocate Ranjan Lakhanpal, who was Bagi’s counsel,  said Bagi was in a terrible state after learning that a Patiala Court had declared him dead. “We have decided to file a case against Bagi’s wife Naseeb Kaur and children for causing harassment and mental trauma,” he said.
All these years, Kaur had been getting family pension and allowances after she submitted  a court certificate to the IAF authorities stating that her husband was dead.

Lakhanpal said after retiring from the IAF, Bagi went into hiding in 1987 as he had received threats from various terrorist outfits. For long, Bagi  stayed at various places in Orissa and Kolkata. “When he returned home in 1998, his wife and children refused to recognise him,”  counsel said.  Bagi is owner of assets worth millions of rupees.
