Hearing a public interest litigation (PIL) by L Vasudevamurthy, former academic council member, BU, the division bench headed by Chief Justice J S Khehar adjourned the matter.

The petitioner has sought to know about the action taken against Mylarappa, under Section 49(2) of the University Act. He had submitted that the Government Auditor in his report disclosed that over Rs 70 lakh was misappropriated during Mylarappa’s tenure as the director of distance education department of BU.

The petitioner had challenged the Higher Education Minister's order dated October 7, 2008, which annulled the resolution of the BU Syndicate. The syndicate had called for a CID inquiry into Mylarappa’s involvement in the alleged misappropriation of amount during his stint as director. The petitioner also argued that the Government has no right to withdraw the FIR.
