Advocates and activists who have been protesting the arrest of young activist Disha A Ravi submitted a memorandum to Home Minister Basavaraj Bommai on Friday, reminding that the arrest violates the principles of federalism upheld by the Supreme Court in a case fought by his father and former chief minister SR Bommai.
A delegation of advocates, farmers groups, workers unions and others met the Home Minister and demanded action against the Delhi Police for the "criminal arrest" of Disha.
The activists sought to stress that they were not only protesting the arrest but also the manner in which Disha was taken away to Delhi. It noted that the Delhi police violated the directions of the Delhi High Court which laid down guidelines for inter-state attest in Sandeep Kumar v State (NCT) of Delhi (2020).
The high court had held that the police should follow section 80 of CrPC and present the accused before a local magistrate before taking them to another state.
Stating that the arrest also violates the principles of federalism, upheld by the Supreme Court in SR Bommai Vs Union Of India on March 11, 1994.
The court had said, "Federalism envisaged in the Constitution of India is a basic feature in which the Union of India is permanent within the territorial limits set in Article 1 of the Constitution and is indestructible."
