Justice V.Ramasubramanium passed the order and posted the matter for further hearing on January 18.
Akash and Vanitha, daughter of Tamil actor Vijiyakumar, have two children, including the minor boy, Vijay Sri Hari. They obtained a divorce in 2007 from a court in Secunderabad.
Vanitha got married to Anand Rajan in 2000. In her habeas corpus petition filed last year, she sought production of the boy before the court and to hand him over to her, alleging that Akash had forcibly taken away her son from her custody.
As inteim measure, the court granted Akash two weeks to hand over his son to her mother and allowed him to move the appropriate court to seek custody of his son.
Following a court direction last month, Akash moved the family court at Secundarabad seeking permanent custody of his son. But the court returned his petition to move appropriate court in Chennai ,since his first wife and Vijay Sri Hari were not residents of Secundarbad. Hence the present petition before the High Court.
In his petition he submitted that he loves the minor children and had not remarried only for that sake. He has adequate source of income and means to maintain them, he said and sought to restrain his former wife and her husband from interfering in the custody of his minor son.
