“Taking the overall facts of the case and the gravity of the offence into consideration,” the applicant was required for “specific interrogation”, Judge B P Deshpande, who heard the plea, ruled in the much-awaited order on the NCP MLA on Thursday.
Meanwhile, the crime branch moved immediately to book the former minister who has been in hiding for a week, under Sections 304 (culpable homicide not amounting to murder), 306 (abetment to suicide) and 201(destruction of evidence) of the Indian Penal Code.
No self poision intake
The court said that the autopsy findings of injuries on her body and the statement given by Nadia’s mother to Apollo Victor Hospital, Margao when she was rushed there on May 15, ruled out the possibility that Nadia had taken rat poison by mistake.
Going by the material presented before the court Nadia could have either been induced to take the poison or given it forcibly, the judge said.
Aide denied bail
Pacheco’s aide Lyndon Moteiro who was denied anticipatory bail on Wednesday by the session court filed an appeal before the High Court of Bombay at Goa on Thursday.
