A bench of Justices Sanjiv Khanna, Sanjay Karol and Sanjay Kumar said another bench in which Justice Kumar is not a member will take up Sisodia’s two separate pleas for reviving his bail petitions in cases filed by the Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) in the excise policy scam case. Senior advocate Abhishek Singhvi, appearing for Sisodia, requested the bench to list the matter urgently, saying time is of essence. He said the trial has not yet commenced in both the cases. A three-judge bench of the Supreme Court will hear on July 11 a plea by the AAP and former minister Manish Sisodia to revive an earlier petition seeking bail in Delhi excise policy case that was disposed of by the apex court.

"While arresting Arvind Kejriwal, the ED intentionally omitted statements and evidence that were exculpatory and indicated his innocence, for no rhyme or reason. These statements were wilfully concealed from the accused persons as well as the court," it charged.

All the statements based on which the ED arrested Kejriwal were taken before July 2023, AAP said.

"Then why did it wait eight months to arrest him just before the commencement of the general elections? The same evidence was shown to the Supreme Court during Manish Sisodia's bail hearing. On the same evidence, the Supreme Court has held that no involvement of Manish Sisodia was found in connection with the alleged transfer of Rs 45 crores," the AAP further said.

After SC judge's recusal from hearing Sisodia's pleas for reviving bail petitions, another bench to hear matter on July 15.

As soon as the matter was taken up for hearing, Justice Khanna said, "Our brother has some difficulty. He will not like to hear this matter for personal reasons."

On June 4, the top court had refused to entertain the bail pleas of Sisodia in cases lodged by the CBI and the ED in connection with the alleged Delhi liquor policy scam.
