The order was passed a Division Bench comprising Justice Imtiyaz Murtaza and Justice Ram Autar Singh on a writ petition filed by Sawant who had challenged the FIR lodged at Prem Nagar police station of Jhansi by one Savitri Devi whose son Laxman had taken part in the TV show hosted by the actress and died a few weeks later.
The court, while granting the stay on Sawant's arrest, asked the state government to file its counter affidavit within four weeks.
The FIR alleged Laxman had visited Mumbai to take part in the TV show with the hope that it would help him resolve his estrangement with his wife.
However, it has been further alleged in the FIR that he was called "naamard" (impotent) by the actress after which he returned home feeling humiliated.
The FIR said that after the episode featuring him was telecast, Laxman became depressed and started saying that his life was ruined and gave up taking food. He later fell ill and died in a hospital where medical reports had described his condition as "tension stricken".
