<p>Deepak, a City-based advocate has filed a petition seeking directions to the government to withdraw the Cabinet decision on night safari.<br /><br />The petitioner had submitted that the decision to start a night safari in the Biological Park violates Section 35 (6) of Wildlife Protection Act. <br /><br />Under the provision, no person shall destroy, exploit or remove any wildlife from a national park or destroy or damage or divert the habitat of any wild animal, the petition said. He said that Bannerghatta, being a national park spread over 25,000 hectares is a home to one animals like elephant, sloath bear, wild dog, leopard and other mammals. <br /><br />The park, a mix of thorny, scrub, dry and moist deciduous patches is also home to 215 species of birds, 150 species of butterflies and 20 species of snakes and over 250 varieties of trees.<br /><br />He has contended that the decision to introduce night safari will disturb the animals and is a violation of Articles 48 (A) and 51 (A) (g) of the Constitution. <br /><br />The Division Bench headed by Justice Manjula Chellur adjourned the matter.<br /><br />Bail plea adjourned<br /><br />The Karnataka High Court on Tuesday adjourned the hearing on bail petition of self-proclaimed godman Nithyananda to June 14. The matter was adjourned as Justice Subhash B Adi, who is hearing the matter is on leave. When the case came up, Justice C Kumaraswamy adjourned the case stating that since the case had earlier been heard by Justice Subhash B Adi and since he was on leave, only he would hear Nityananda's bail application and pass orders.<br /></p>
